Okay, now that I’ve recovered from my Election night (and, by the way, birthday night) hangover, let’s try to figure out where the hell we are.
By now, everyone knows that the House of Representatives went to the Dark Side by a wide margin. And while The Force still controls the U.S. Senate, it is by a razor thin margin. But the one thing you must remember is that there are a number of Senate Democrats who vote pro-life. I have yet to see an analysis by the pro-choice groups, but although the Democrats still run the Senate, the pro-life forces are in pretty decent shape over there as well. In the House, they are firmly in control.
So, what this means is that the House of Representatives will pass any pro-life piece of legislation that is offered. They will no doubt come up with all sorts of ways to make abortion less accessible. We will probably see some kind of national 24 hour waiting period, so-called “informed consent” measures requiring women to view photos of the fetus, etc. Anything that is proposed will pass. However, the Republican Party is not dumb enough to go all the way and try to pass a bill or constitutional amendment banning abortion. That ain’t gonna happen folks. That’s because there’s no guarantee that they have the necessary two-thirds vote in both houses. And the Republicans are thinking that if they’re gonna lose, why ask their folks to stick their neck out on this controversial issue and piss off a bunch of possible pro-choice independents when the measure is unlikely to become law?
So, the House will pass some things and then send it to the Senate. Pro-life forces basically need 60 votes to pass something in the Senate and those votes over there will be close. But, let’s say they do pass a 24 hour waiting period. Fortunately, sitting down at the other end of Pennsylvania Avenue (at least for now) is pro-choice President Barack Obama. If any pro-life bill comes to his desk he’ll veto it and that will be the end of it.
So, as far as attacks on the accessibility of abortion, there will be a lot of talk. You will get a lot of fundraisingletters from both sides asking you to contribute money to help their lobbyists fight the good fight but, at the end of the day, ain’t nothing terrible gonna happen.
There is one real problem, however, in the U.S. Senate. And that has to do with the situation when/if Obama gets to nominate another justice to the U.S. Supreme Court. That’s where it will get very interesting. Without having seen the exact numbers, I can virtually guarantee you that the pro-choice forces do not have the necessary sixty votes to confirm an obviously pro-choice justice. And while great deference is often given to the President’s nominee, if Obama nominates a clear pro-choice justice, there will be a major battle. That’s because the Court right now favors Roe v Wade by a 6-3 margin. If they can pick up another pro-life vote, then it becomes a 5-4 margin in favor of abortion rights. So, come nomination time the pro-lifers will be smelling blood.
So, the bottom line is that Obama will have to nominate some “stealth” candidate who has no clear position on abortion. It will be a crapshoot. And as history shows, other presidents have found themselves in a similar situation where they nominated someone hoping they would follow the President’s ideology only to find them on the other side of the fence. This could happen to Obama.

You forget the role of the Great Compromiser in the White House, Pat. Since he negotiates by giving away the farm in the first round, you’re likely to see any so-called “pro-life” legislation in the Senate initiated with a promise from the White House that whatever the result, it will be signed.

i can see president obama passing legislation brought about by pro-lifers.
so many lifers refer to him as the most pro-abortion president in history, but choicers saw a different side after he was inaugurated.
i think many people fall within a spectrum on the topic and he is no exception.

You’re right, Lorraine, we are lucky he got two solid pro-choice votes in there. It will be interesting, however, to see if someone like Ginsburg will resign thinking that Obama might be a one term President to give him a chance at a nomination.

Melissa: That’s not what I’m saying. I’m saying that in the next decade or two, we could lose Roe v Wade. It’s 6-3 in favor of Roe right now. that means if the antis pick up only two more votes, we’re dead in the water. And as I said in my last piece, Obama does not have the luxury of being able to nominate a clear pro-choicer next time around. Then, if we wind up with President Palin or Romney in 2012, there is more room for mischief. And don’t get complacent because Roe is “established precedent.” Ain’t no thing anymore. The Supreme Court is just as political as any political organization these days. Scalia and Alito and Roberts would toss Roe out in a second if they had the chance….

Pat, I hate to get off the subject here, but I’m lonely. A couple of times I asked if any of your academic friends might have any input on my RESPONSIBLE Right to Life site, and you put it out there. No responses so far, although there was one message suspiciously titled, “About your website,” which I didn’t open because I suspected it was just trying to introduce a worm or virus into my computer.
It’s really depressing that no academic finds it more interesting than warm spit, but if that’s the way it is, that’s the way it’s gonna be….

CG: I honestly think that the “spotlight” on abortion and abortion rights and the antis has faded over the years. Even though there is “stuff’ going on, including a murder, many many people are tired of the issue and they think there just ain’t a lot of new stuff to talk about. Rachel Maddow had an abortion doctor “in the shadows” last night talking about threats and my first reaction was “been there, dont that.” Yes, I’m concerned and pro-choicers need to be vigilant but there ain’t much I can do about it. I suspect that a lot of academics are just plain ole bored as well and thus might not be interested in your stuff, no matter how interesting it may be…

Allow me to gloat and, perhaps, celebrate the news. Operation Rescue/Operation Save America’s Philip “Flip” Benham was found guilty of two charges of criminal stalking with intent to cause emotional distress and disruption of domestic tranquility for residential picketing. Benham and his associates were ordered to stay 300 feet or more from wherever the targeted doctor works and 1,000 from his residence. Benham was put on two years probation. So while we all grow weary of this, there’s always a story out there that warms our hearts.
I’d say that John Dunkle ought to pay attention, especially considering how he loves to cause emotional distress and disrupt domestic tranquility in a residential area.

It’s unlikely that Flip went through therapy (AA, etc.) for his alcoholism, and as a result, he’s just a “dry drunk,” freighted with the same disabilities that kept him drinking in the first place.I think that if he had gone through AA, he wouldn’t be able to continue to be dishonest enough to remain a so-called “pro-lifer.” Successfully recovering alcoholics are much more honest about who they are and why they do what they do, and being so-called “pro-life” is at variance with that.
To be one, Benham has to be manipulative in a way that works at cross-purposes with AA’s 12-step program. He’s chosen the dysfunctional 12-step program instead.

Rogie, I was the national lobbyist for the Nat’l Abortion Rights Action League for 4 years, then was with the Nat’l Coalition of Abortion Providers for 13. So, it’s hard not to meet a lot of people. Remember, also, that the abortion provider community is a small, close knit group that often had to huddle together to survive. I got to know these folks intimately – sometimes I got to know them too well !!

Welcome back, Rogelio! The above contretemps has to do with the fact that the “pro-lifer” involved has never explored, discussed or explained why he cannot (or does not) show for real children the passion and concern he displays about fetuses. It’s a cognitive dissonance which begs to be understood. I am happy that he can spot a phony, irrelevant as that is to the issue under discussion.
I just got back from a visit to a place that mandates single-child-only families. When I asked the young hottie interpreter how people in general felt about it, she said, “Young couples generally feel children are a nuisance.” Better to feel that way when you don’t have children, rather than when you do!
She and her husband have a daughter and live in a three-room apartment. I didn’t ask where their bathroom was.

Before this post disappears, I want to refer you to a wonder section in “No Country For Old Men.” At a meeting the narrator and his wife are siting next to a women who has been defending the role of the killers’ helpers. After a long while she says, “I just want my granddaughter to be able to have an abortion if she wants.” The narrator says, “Oh, that will happen, and she’ll be able to put you to sleep too.” The conversation ended.
