The lovely state of Arkansas has now banned all abortions after 20 weeks. Not a particular surprise to most political folks but I have got to give a shout out to Governor Mike Beebe who actually vetoed the bill the first time through. Yes, he was ultimately overridden by the legislature but vetoing that bill (especially when he knew he would lose in the end) took a LOT of guts. As for the new law, I have to assume that it will be challenged in court by the ACLU or the Reproductive Rights Project.
What boggles my mind is that while most objective constitutional scholars believe that the law will be declared unconstitutional, that didn’t seem to bother these legislators in Arkansas. Nope, they just wanted to make their political points, which make the Governor’s action even more meritorious because he certainly hasn’t won many points for his action.
Indeed, one wonders if the legislators really knew what they were doing. No doubt they were just dragged by their short hairs by the local anti-abortion yahoos who told them “the truth,” or, more accurately, “their truth.” I can see them now cornering one of their folks, telling them that after 20 weeks it’s a baby, gosh darn it, and we gotta protect the little ones from their oh-so-promiscuous mothers, now don’t we?
What the legislature probably never heard was that most abortions at that point are not done because the woman can’t fit into her prom dress – a common argument that has been posed by years by the antis. If the legislators really cared to know “the truth,” they would have heard that late term abortions are done for far more compelling reasons (although, for the record, a woman can get an abortion up to 24 weeks without giving any reason).
Years ago, I visited a clinic in Michigan that performed abortions up to 24 weeks. With her permission, I accompanied a young woman who was seeking an abortion at 22 weeks. She was receiving financial assistance from the government, lived in subsidized housing and did not have the money or insurance to get regular prenatal care. Ultimately, she went to an Ob-Gyn who informed her that her baby had encephalitis, a swelling of the brain that caused the head to be dangerously oversized. He said that chances were that the baby would not survive and could, in fact, harm the woman during delivery. The woman, through her tears, told me she felt she had to abort her child.
At one point during the process, we were in the sonogram room and the nurse turned on the machine, coated her stomach with gel and together we watched the image on the screen. At one point, she reached out to take my hand. The image was very clear. She actually said “oh, look at my baby!” She asked the nurse several questions and I could barely hold back my tears as the patient talked in rather clinical terms about the image on the screen. Then, the nurse asked her if she was ready to proceed. The woman sighed, as if she might be having second thoughts and then she simply said “yes, I need to do this.”
Did the legislators in Arkansas even think about the cases like this? Actually, were they even told about cases like this? We’ll never know but I’m sure those who voted for the bill just keep thinking about “killing babies that would survive outside of the womb” (questionable) at 20 plus weeks. I’m sure they never even considered the woman. But what else is new, huh?
If this law actually goes into effect, more women will be forced to bear babies against their will. The woman I met would have had to carry her baby for several more weeks and then probably watch it die.
And the war against women continues.

patty, most antis don’t tend to even ask why it is that a woman seeks an abortion.
maybe if we talked less and listened more, we would stop worrying about saving the babies and worry more about saving the women and see that more babies are saved by default by doing this, than by any other tactic.
and even if she still chooses to abort, trying to help her overcome the life circumstances that she faces gets her out of those circumstances and something good has still come from it.
one of the things that confuses me about anti legislators is that they are the same ones that will cut social services that lower income women need to properly care for their children.

Evan: I think even the most conservative of legislators would say that they are, in fact, “interested in social services.” I’ve never heard any conservative say that all social services should be eliminated. They do think, however, that the services are abused and should be cut.

As always, Rogie, a voice of wisdom in the pro-life community! I think that’s what bothers me about many antis. The dont consider the motivation of the woman. They just assume she is a selfish baby killer. They dont realize that the decision to abort is so incredibly difficult but for whatever reason, they feel compelled to do it. And many antis just ignore the women and focus on that unborn thingy. Good to hear from you!

So now if a woman in Arkansas wants an abortion after 20 weeks she will now be forced to travel out of state to obtain an abortion and there by increasing her risks of dying from the abortion, wow that makes so much sense to me. This scenario sounds awfully familiar to me for some reason and it shouldn’t.
I just do not understand the logic behind this nor do I understand the logic as to why my having an abortion is anybody’s business but mine. Since when does my having an abortion affect anyone but me? I just wish people would mind their own business, stay out of mine and find something better to legislate than my body.

Logic? C’mon, Sarah Rose, since when does logic have anything to do with this? The interest groups come in, talk to the legislator and like lemmings to the sea, they vote accordingly. But the same goes for the pro-choice legislators. Just once, I would like to see a legislator who has a 50-50 voting record on the issue, meaning that person is actually thinking about it, weighing the consequences and having some actual angst about the issue (which most americans do).

Glenda, they are not a bunch of lunatics in Arkansas so much as the state is being taken over by the Koch Brothers. Beebe is probably on his last term. I recommend to all to check out the Glenn Greenwald video, “Koch Brothers: Exposed.” The only counter to their impending plutocracy is to find a plutocrat who believes women should have the right to decide how many children she wants to bear.

Not sure that the Koch brothers instigated this one, Charles. Yes, they are expanding and Arkansas is good territory for them but the pro-life movement in Arkansas is pretty organized. No doubt they just heard about similar bills in other states (e.g., Georgia) and they copied it and gave it to their friendly legislators.

Arkansas Governor Mike Beebe (D) vetoed a controversial bill on Monday that would ban abortions after just 12 weeks of pregnancy. If enacted, the bill would be the most extreme abortion restriction in the country.
Arkansas’ newly GOP-led Senate gave final approval to the 12-week ban last week by a vote of 26-8. The bill includes exceptions for rape, incest, life of the mother and highly lethal fetal disorders.
Beebe vetoed a similar bill last week that would have banned abortions after 20 weeks, but the state legislature voted to override the veto.
Beebe said in a statement that he vetoed the abortion bills because they were likely to be found unconstitutional and would cause the state legal problems, which could be highly costly to taxpayers. Most states, based on the guidelines of the 1973 Supreme Court decision in Roe v. Wade, allow abortions at least until the fetus would be viable outside the womb, which usually occurs between 22 and 24 weeks of pregnancy.
“In short, because it would impose a ban on a woman’s right to choose an elective, nontherapeutic abortion well before viability, Senate Bill 134 blatantly contradicts the United States Constitution, as interpreted by the Supreme Court,” Beebe said in a statement. “When I was sworn in as governor I took an oath to preserve, protect, and defend both the Arkansas Constitution and the Constitution of the United States. I take that oath seriously.”
