I would be remiss if I did comment on the case of Doctor Kermit Gosnell.
As many of you know, Doctor Gosnell performed abortions in the Philadelphia area for many years. Then, in late 2011, he was indicted for, among other things, eight counts of murder. In addition, several of his staff people, including his wife and sister in law, were also charged with assisting in botched abortions, practicing medicine without a license or covering up the actions of those who did. One of them, Adrienne Moton, has already pleaded guilty to third-degree murder as well as conspiracy and other charges and is in jail. Other staff people have also pleaded guilty and have testified at the trial.
In all my years at the National Coalition of Abortion Providers, I never heard of Doctor Gosnell. And I surely don’t know if he is innocent or guilty of the charges. Of course, if you read the latest reports from the pro-life media, he is clearly guilty of running a “chamber of horrors” even though the defense has not even presented its case. While some of the testimony that has been presented so far appears rather damaging, I choose to actually let the judicial process play out because – dare I say it – I do believe that one is innocent until proven guilty. Unlike my pro-life friends, who eschew the protections in the Constitution, I’ll wait to see what the jury has to say.
But I will add that the testimony so far has been rather shocking and, if he is found guilty, they should lock him up and throw away the key.
This case has put the pro-choice groups in a quandary. First, there were some reports that a staff person with the National Abortion Federation actually examined his facility and recommended that he not be permitted into the organization. But after that, he continued to perform abortions. Then, Brenda Green, executive director of CHOICE, a nonprofit that connects the underinsured and uninsured with health services, said that she “tried to report complaints from clients, but the health department wouldn’t accept them from a third party. Instead, the patients had to fill out a daunting five-page form, available only in English, requiring them to reveal their identities upfront and be available to testify in Harrisburg.” He was like a cockroach who could not be stamped out.
Unfortunately, many women considering an abortion don’t even know how to check out the doctors. They often just decide who to go to based on the cost of the procedure and, like other medical services, if you are looking for the cheapest price, you may pay for it in more ways than one. NAF does have a section on their website which tells women what to look for when choosing a clinic but how many people even know about NAF? So, it does not surprise me that some women made their way to Doctor Gosnell.
But the tougher question is what do the pro-choice groups do if they know there is a “troublesome” doctor? It’s hard to make allegations if you do not have very specific information but the information has to come from the women and they don’t want to even admit they had an abortion. To be sure, one hears rumors but one has to be extremely careful lest one get sued for slander. Indeed, years ago I was quoted in the New York Times suggesting that women not go to a certain doctor with clinics up the east coast and within two days I had a “cease and desist” letter from his attorney threatening to sue our organization and me personally. I can tell you that a threat like that certainly makes you think about criticizing someone publicly.
The bottom line – and it’s a tough one – is that women have to learn to expect more and they need to speak up when they experience substandard care in an abortion facility (or any other medical facility). Then the authorities need to react quickly and with certainty. For years, we talked to numerous health authorities about that doctor on the east coast and while he lost his license in one state, he kept opening up clinics in other states. To be sure, the pro-lifers will say that clinics need more regulations and this may come as a surprise but many clinics are not adverse to discussing well-intentioned and useful regulations. But they will not cooperate when those regulations are designed solely to put a clinic out of business.
One final note about this case. If the allegations are true, Doctor Gosnell is an aberration amongst abortion providers. The vast, vast majority of women obtain abortions in comfortable and safe environments but, unfortunately, the media would rather focus on Doctor Gosnell than those who are merely offering safe abortion services to hundreds and thousands of women each year.

I don’t see what the big deal is.
There are dirt-balls in every profession. It is rare to read real cases of bad abortion doctors.
We read daily about criminal lawyers and politicians and Anti Choice people.
Let the judicial system proceed to take care of this one fringe doctor.
We can wallow in the fact that the vast majority of Abortion Providers are excellent at what they do . . . far better than most of their critics . . .

Oh, I agree Glen, there are dirt balls in every profession. The problem, of course, is that when a dermatologist is found to be running a bad operation, it is usually not covered in the press. But when the press has the opportunity to say the “A” word, then they run with it. And that then forces pro-choicers to respond because if they dont, they look complicit in their silence.

The Women’s Law Project article “Questions No One is Asking” about the Gosnell trial points out the harsh realities of why women went to him. One of the reasons was obvious—location. He was cheaper than others which was huge. And many women testified that other clinics had nasty protesters while Gosnell’s clinic did not. Of course, all the so-called Christian, lily white protesters did not worry about that clinic.
For those women who need a Gosnell-type clinic today, they can use the over the counter pill regardless of their age, thanks to the new FDA ruling yesterday. Those who trust women to make their own choices should thank (and donate $$$ to) the legal team at the Center for Reproductive Rights for their work in making this ruling possible.

The Grand Jury report on the Gosnell case is a painful read. Among its conclusions is that the PA Dept of Health had not done the statutory required reviews since something like 1992. Furthermore, before that he had been cited for not following procedure as set forth in those statutes.
One reason mentioned in that report as to why protesters didn’t bother with him is that he was located in a part of the city where they feared to go (you know, populated by low income Blacks).
In response, the anti-choice PA Republican controlled legislature with an anti-choice Republican governor passed a new law regulating Abortion clinics that makes it very unlikely any new 2nd trimester clinics will open in the state. Existing clinics got some grandfathering, but there is no guarantee this cannot be withdrawn.since I believe this was a DOH decision, not part of the new law.
While the decision to allow the OTC pill without age restrictions is important, I don’t think it will make a huge impact overall. My guess is that most of the youngsters who can now buy this drug without parental involvement won’t consider the pregnancy possibility until the first missed period.
What really scares me is that as the anti-choice crowd succeeds at nibbling away abortion options by state laws that make abortions harder and harder to get, Gosnell-like clinics will become more prevalent: when legislatures try to take away something people want, other people see an opportunity to fill the gap, and they do not let legalities get in the way.

Your comments are spot on! The unfortunate practice, evident in many arenas, is to respond to the obvious with rulings. Too many accidents at one intersection, do nothing until someone important dies or until the accident is particularly gruesome. It’s no different than with abortion providers. But Gosnell was arrested not because of abortions but because of drug dealing. The abortion issues came later.
The unfortunate practice with reproductive health care, to my way of thinking, is that those who would devise rules and legislation, ignore the potential for the “what if” scenarios. They are simply unable to think critically, to project the potential hazards of human nature and the science of medicine and psychology preferring data drawn actuarial tables, engineer’s mathematics, laws of physics or their religious dogma.

Why don’t you just admit that you elected liars and you were more than happy to cheerlead for the wars that killed babies and their families especially during Shock and awe while you salivated over their deaths in front of you TV. I don’t know how else to say this other than all of you were a 1 week old child and then a 2 week old child and then a 3 and 4 and 5 and 6 and so on until you were born. You have made an indelible mark on this world and it is beautiful and unique and no one else could have done what you have done. No one. In the same manner, the millions of children aborted, 1/3 of my generation would have made an indelible mark on this world as well. They would have been unique like you and me and they would have been beautiful too.
The fact of the matter is children are being killed. Dr. Gosnell, whether he is convicted or not, killed children and because our society has embraced a culture of death and passivity we have stood by and let it happen. We have let 1/3 of a generation silently die.
I don’t blame the women, I don’t blame the men, I don’t even blame the pro-death(choice) movement. I blame the timid people, the people who have been afraid to offend, the people who have suffered from an abortion, see it for what it really is but won’t speak up, I blame the self-righteous who think that the sins of women who have gotten abortions are beneath them, I blame the people who are doing absolutely nothing to stand up, speak out and end the need for the abortion industry.
But right now, I want to ask you to just take a moment and ask yourself why are you so vehemently pro-death or pro-choice, or whatever you want to call it. Why? Why are you OK with being alive but not affording other children the same opportunity? Why are you any better or more entitled to life than an unplanned or unwanted pregnancy?
I don’t understand it. I mean, I really and truly cannot understand.
I don’t want to be another pro-life person that makes you feel like crap or makes you angry or makes you anything other than think. Think about the gifts you’ve brought to this world, think about the beauty of living and then think about whether you really are OK with abortion, the killing of a child who is destined to make an indelible mark on the world if only they are given the opportunity to do so.

Lauren, I really appreciate your post and respect your views. I’ve worked with clinics for many years and have talked to many, many women in the waiting rooms. None of them – none – wants to be there but they tell me that they feel that for whatever reason, they cannot bring a child into this world at that point. So, they seek out the abortion doctors. It’s a sad situation. The mother knows exactly what she is doing and whatever you call it – killing, terminating, aborting – whatever, the woman knows that were it not for the procedure, she would give birth. And, if a doctor was not available at that point, then, as history shows, the woman might resort to a self induced abortion or go to an unqualified person.
It’s a very tough decision. I respect your thoughts and opinions. I would hope you would respect the literally one million women a year who also have a thought and opinion on this serious issue.

I have a great love for life and for children and my desire is that no pregnancy would ever be unwanted and that our society would take away the stigma of pregnancy outside of marriage as being an atrocity and see it for what it is: a woman and a child who need love and assistance and protection.
Like I said, my hope and prayer is that The Lord will use me to help support women and men dealing with pregnancy in what looks like an unplanned situation and to show love to women and men who have made the decision to abort their child and need love and mercy.
We all need someone to love us, to help us, to show us the good in ourselves when all we can see is the bad and to guide us to a place of healing and acceptance of our pasts. Every saint was a sinner and every sinner has a future.
